Diamond Art World® (“we,” “us,” or “our”) operates the website https://diamondartworld.com (the “Site”). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit the Site, create an account, place or attempt to place an order, upload a photo, submit a review, contact us, or otherwise use our services.

For the purposes of applicable data protection laws, Diamond Art World® is the controller of the personal information described in this policy, except where another party, such as Shopify or a payment provider, acts as an independent controller for its own processing.

1. Personal Information We Collect

Depending on how you interact with us, we may collect the following categories of personal information:

  • Contact and account information: name, email address, telephone number, billing and shipping addresses, account login details, and communication preferences.
  • Order and transaction information: products viewed or purchased, cart activity, order history, discounts, gift cards, delivery information, returns, refunds, and customer service records.
  • Payment information: payment method, payment status, billing details, and limited transaction information. Full payment card details are generally collected and processed directly by Shopify and the payment provider selected at checkout rather than stored by us.
  • Device and usage information: IP address, browser and device type, operating system, cookie identifiers, approximate location derived from an IP address, referring pages, pages and products viewed, searches, clicks, session activity, and date and time information.
  • Communications: emails, contact-form submissions, customer support requests, warranty claims, photographs of product issues, and other information you choose to send us.
  • Custom-product content: photographs, images, instructions, and other content submitted for a custom diamond painting kit.
  • Reviews and other user content: review text, ratings, photographs, videos, display name, and related information submitted through our review tools.
  • Marketing and preference information: email and browser-notification subscriptions, consent records, advertising preferences, and interactions with marketing messages.
  • Promotion and affiliate information: information submitted when participating in a promotion, review incentive, survey, or affiliate program.

The categories listed above describe our current practices and, where applicable, the categories of personal information collected during the preceding 12 months.

2. How We Collect Personal Information

We collect personal information:

  • directly from you when you place an order, create an account, upload a photograph, contact us, submit a review, subscribe to marketing, or participate in a promotion;
  • automatically through cookies, pixels, log files, local storage, and similar technologies when you use the Site;
  • from Shopify, payment providers, fraud-prevention providers, shipping carriers, production and fulfillment partners, and applications used to operate the store; and
  • from advertising, analytics, social media, and marketing partners where permitted by law.

3. Custom Photo Uploads

Photos uploaded for custom diamond painting kits are used to prepare, manufacture, fulfill, and support your custom order. The uploaded image may be shared with our secure upload provider and selected production and fulfillment partners only to the extent reasonably necessary to provide the requested product and related customer service.

An uploaded image may contain personal information about you or another person. Please upload only images that you are legally permitted to use and share with us. We do not use custom photographs for unrelated advertising or make them publicly available without permission.

Custom photographs are retained only for as long as reasonably necessary to fulfill the order, provide customer support, resolve quality or legal issues, and meet applicable recordkeeping requirements. They are then deleted or anonymized in accordance with our retention practices.

4. How We Use Personal Information

We may use personal information to:

  • operate the Site and provide its features;
  • process payments, prepare and fulfill orders, arrange delivery, and provide tracking information;
  • create and manufacture custom diamond painting kits from submitted photographs;
  • manage accounts, returns, refunds, warranty claims, and customer support;
  • communicate about orders, services, policy changes, or customer inquiries;
  • detect, investigate, and prevent fraud, abuse, security incidents, and unlawful activity;
  • analyze Site performance, understand how visitors use the Site, and improve our products and services;
  • personalize content, measure advertising performance, and show relevant advertising where permitted by law;
  • send email marketing or browser notifications where you have consented or where otherwise permitted by law;
  • administer reviews, promotions, surveys, discounts, and our affiliate program;
  • enforce our terms, protect our rights, and resolve disputes; and
  • comply with legal, tax, accounting, regulatory, and law-enforcement requirements.

We may use automated tools to screen orders and activity for fraud or security risks. Where applicable law provides a right relating to a decision based solely on automated processing, you may contact us using the information in Section 17.

5. Legal Bases for Processing

If you are located in the European Economic Area, United Kingdom, or Switzerland, we process personal information under one or more of the following legal bases:

  • Performance of a contract: to process and fulfill your order, produce a custom kit, deliver products, and provide requested customer service.
  • Legitimate interests: to operate and improve our business, prevent fraud, secure the Site, understand Site performance, communicate with customers, and protect our legal rights, provided those interests are not overridden by your rights.
  • Consent: for certain marketing communications, browser notifications, non-essential cookies, and advertising technologies. You may withdraw consent at any time.
  • Legal obligations: to maintain required records, respond to lawful requests, and comply with tax, consumer-protection, accounting, and other applicable laws.

6. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients for the purposes described in this policy:

  • Shopify: our commerce platform, hosting provider, checkout provider, and related service provider. Shopify may also process information for its own services as described in the Shopify Consumer Privacy Policy. Shopify privacy choices are available through the Shopify Privacy Portal.
  • Payment providers: Shopify’s payment infrastructure, PayPal, card networks, banks, and other payment services selected at checkout.
  • Production, fulfillment, and delivery partners: manufacturers, warehouses, shipping carriers, and logistics providers. Custom photographs are shared with production partners only when required to produce or support the ordered custom kit.
  • Store applications and service providers: providers supporting photo uploads, discounts, gifts and cart functions, fraud prevention, customer accounts, technical support, hosting, and Site operations. These currently include Cloudlift and applications used for cart discounts and promotional gifts.
  • Analytics and advertising partners: Google and Meta, including Google Analytics, Google advertising technologies, and the Meta Pixel, where permitted by law and subject to applicable consent or opt-out choices.
  • Marketing and notification providers: Brevo for email marketing and PushOwl for browser notifications and related messaging services.
  • Review provider: Judge.me for collecting, managing, and displaying product and store reviews.
  • Professional advisers: accountants, attorneys, insurers, auditors, and other advisers where reasonably necessary.
  • Authorities and legal recipients: courts, regulators, law-enforcement agencies, or other parties when disclosure is required by law or reasonably necessary to protect rights, safety, and security.
  • Business transaction recipients: actual or prospective buyers, investors, lenders, or advisers in connection with a merger, financing, restructuring, sale, or transfer of all or part of the business, subject to appropriate safeguards.

We may also disclose information at your direction or with your consent. The categories above describe our current practices and, where applicable, disclosures made during the preceding 12 months.

7. Cookies and Similar Technologies

We and our service providers, including Shopify, use cookies, pixels, tags, local storage, and similar technologies. These technologies may be used for:

  • Essential functions: security, checkout, cart contents, account login, fraud prevention, network management, and remembering privacy choices.
  • Functional purposes: remembering settings and improving Site features.
  • Analytics: measuring traffic, performance, and interactions with the Site.
  • Advertising: measuring campaigns, building audiences, and providing advertising based on activity across websites where permitted by law.

Where consent is required, we use non-essential cookies and similar technologies only after obtaining the required consent. You can manage available choices through the cookie banner or Cookie Preferences link when displayed on the Site. You may also adjust your browser settings, although blocking essential cookies can prevent parts of the Site from working correctly.

We do not sell personal information for money. However, our use of advertising cookies and pixels may involve disclosing identifiers and Internet or device activity to advertising partners. Under certain U.S. state privacy laws, this may be considered “selling,” “sharing,” or processing for “targeted advertising.”

Where available, you can use the Cookie Preferences or Your Privacy Choices link displayed on the Site to manage non-essential cookies or opt out of data sharing for targeted advertising. Where required by applicable law and supported by our privacy tools, we recognize browser-based opt-out preference signals such as Global Privacy Control. Because there is no universally accepted standard for other browser “Do Not Track” signals, the Site may not respond to those signals.

Opting out of targeted advertising does not prevent you from seeing advertisements, but the advertisements may be less personalized. Cookie-based choices may apply only to the browser and device on which they are made.

9. Email Marketing and Browser Notifications

You may unsubscribe from marketing emails at any time by using the unsubscribe link included in each marketing message. You can disable browser notifications through your browser or device settings. Even if you opt out of marketing, we may still send non-promotional communications concerning an order, account, policy update, or customer service request.

  • order and transaction records may be retained for the period required by tax, accounting, consumer-protection, and other applicable laws;
  • account information is generally retained while the account remains active and for a reasonable period afterward;
  • marketing information is retained until you unsubscribe, withdraw consent, or the information is no longer needed;
  • support and warranty records are retained for a reasonable period after the matter is resolved; and
  • custom photographs are retained as explained in Section 3.

When information is no longer required, we delete, anonymize, or securely isolate it, subject to legal and technical limitations.

11. International Data Transfers

Diamond Art World® operates from the United States and uses service providers and production partners located in the United States, Canada, and other countries. Your personal information may therefore be transferred to, stored in, or processed in a country whose data protection laws differ from those in your country.

Where required, we rely on recognized transfer mechanisms and safeguards, such as adequacy decisions, contractual protections, or standard contractual clauses. You may contact us for more information about the safeguards relevant to your personal information.

12. Information Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. However, no method of Internet transmission or electronic storage is completely secure, and we cannot guarantee absolute security.

Depending on your location and subject to applicable exceptions, you may have the right to:

  • request correction of inaccurate personal information;
  • request deletion of personal information;
  • request restriction of or object to certain processing;
  • receive certain information in a portable format;

  • opt out of the sale or sharing of personal information or its use for targeted advertising, where those terms apply;
  • request information about automated decision-making and exercise related rights where applicable;
  • appeal our refusal of a privacy request where applicable law provides an appeal right; and
  • receive equal service and pricing without unlawful discrimination for exercising privacy rights.

You have the right to object at any time to processing based on legitimate interests and to the use of your personal information for direct marketing.

We may need to verify your identity before completing the request. Where permitted, an authorized agent may submit a request on your behalf, but we may require proof of authorization and verification of your identity.

You may also manage certain data processed independently by Shopify through the Shopify Privacy Portal.

14. Complaints

If you have a concern about our use of personal information, please contact us first so that we can try to resolve it. Depending on your location, you may also have the right to complain to your local data protection or privacy regulator. Individuals in the European Economic Area may contact the supervisory authority in the country where they live or work. Individuals in the United Kingdom may contact the Information Commissioner’s Office.

15. Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Purchases and custom-photo submissions must be made by an adult or with the involvement of a parent or legal guardian. If you believe a child has provided personal information to us without appropriate permission, please contact us so that we can review and delete it where required.

We may update this Privacy Policy to reflect changes to our practices, services, technologies, or legal obligations. The updated version will be posted on this page with a revised “Last updated” date. Where required by law, we will provide additional notice of material changes.
